Jim’s experience includes commercial litigation for clients facing claims under appointment by liability insurers, cases involving directors’ and officers’ liability, contract and business disputes, shareholder remedies, employment law, surety claims, financial institution liability, municipal liability and commercial fraud.

 

Examples from the accounting and financial services sectors:

  • Has defended over 100 accountants and CPA firms in lawsuits involving errors and omissions claims arising from a wide range of practice areas, including: assurance, compilation, tax, insolvency, wealth management, forensic investigation and other engagements

  • Extensive involvement in dealings with the Institute of Chartered Professional Accountants of Ontario, representing insurance providers, governing bodies and individual accountants. Cases have involved investigations, attendances before the Professional Conduct Committee, contested applications for admission and re-admission, defence of charges before the Discipline Committee, and appeals

  • Has represented victims of sophisticated commercial fraud, including the successful recovery of loss for corporation whose Chief Financial Officer misappropriated close to $2 million through a variety of concealed schemes

  • Successful recovery for group of investors from a major Canadian mutual fund dealer

  • Successful defence of insurance broker in multi-million-dollar claim

  • Routinely acts for insurers in respect of coverage matters and monitoring of complex litigation

 

Examples from the engineering, design and other sectors:

  • Has represented numerous professional engineers in the defence of liability claims alleging negligence in the design and development of large commercial properties

  • He has represented engineers before the Discipline Committee of the Professional Engineers of Ontario

  • Has represented engineers in claims relating to the manufacturing, energy and mining sectors, as well as claims relating to earth works, water treatment facilities and the waterproofing and remediation of underground structures

  • Has represented municipalities and engineers in respect of claims relating to project tender

  • Has been involved in both prosecution and defence of professional misconduct charges before the Law Society of Upper Canada

  • Represented the provincial electrical utility in an extended review of its operations and planning process
